U.S. Immigration Court - affirmative and defensive asylum cases, 2017 This statistic represents the number of affirmative and defensive asylum cases received by the U.S. Immigration Court from 2013 to 2017. The defensive asylum process applies to aliens who appear before EOIR and who request asylum before an IJ. The affirmative asylum process applies to aliens who initially file an asylum application with USCIS and, subsequently, have that application referred by USCIS to EOIR. In 2017, there were 142,961 defensive asylum applications received.
