The European Commission's obligations under Article 17(1) of the Treaty on European Union make the Commission responsible for monitoring compliance with more than 200 pieces of environmental legislation in 27 Member States. Where the European Commission suspects a breach of environmental legislation by an EU Member State, the Commission has the authority to commence legal proceedings in the European Court of Justice.

The conditions of the infringement procedure are detailed in Article 258 of the Treaty on the Functioning of the European Union (TFEU).
